Near Drowning
Pool Submersion
Spa Submersion
Brain Damage • Brain Injury
There are many instances where instead of
a drowning death, a near-drowning event occurs. Near drowning occurs when the child or adult is under water for
an extended period, often losing consciousness after the lungs begin to fill with
water.
This near-drowning event, while even temporary or
lasting only a few moments, can lead to oxygen deprivation. This oxygen deprivation, in turn, can lead to brain
damage or brain injury.

Unfortunately, such brain injury is often
irreversible, leading the pool victim to lapse into a coma or vegetative state. Sadly, death results when
artificial means of life support are shut down by medical personnel and the family.
How Can Near Drowning Events Occur?
Submersion can occur in several
circumstances:
There are, of course, other circumstances which can
lead to near-drowning and resulting brain damage.
You can take action. Seeking damages for the
cost of medical treatment, hospitalization, innovative medical treatments and therapies, rehabilitation, pain and
suffering, and loss of enjoyment of life are several forms of compensation that may be available to your
family.
Importantly, your efforts, if successful, may also
likely lead to prevention of such personal injury and wrongful death occurring to other
families.
